Service Description

New Jersey Pest Control provides residential and commercial pest management services throughout the State of New Jersey. Our services include, but are not limited to, inspection, identification, treatment, monitoring, and prevention of common pests such as termites, rodents, ants, bed bugs, cockroaches, mosquitoes, ticks, fleas, wasps, bees, and wildlife. Treatment methods may include baiting systems, liquid applications, trapping, exclusion techniques, integrated pest management programs, and other industry-standard practices as determined appropriate by our licensed technicians. Service frequency, scope, and specific methodologies will be detailed in your individual service agreement or work order. We reserve the right to modify treatment protocols based on site conditions, weather, pest biology, regulatory requirements, or other factors affecting service efficacy. All services are performed by or under the supervision of technicians holding valid New Jersey pesticide applicator licenses in compliance with the New Jersey Pesticide Control Act and regulations promulgated by the New Jersey Department of Environmental Protection.

No Guarantee or Warranty

NEW JERSEY PEST CONTROL MAKES NO EXPRESS OR IMPLIED WARRANTIES REGARDING THE EFFECTIVENESS OF OUR SERVICES OR THE COMPLETE ELIMINATION OF PESTS FROM YOUR PROPERTY. Pest control results depend on numerous variables beyond our reasonable control, including but not limited to: pest species and biology; severity and duration of infestation; structural conditions of buildings; environmental factors; weather events; neighboring property conditions; and compliance with our preparation and post-treatment instructions. While we employ trained professionals and proven methods, we do not guarantee that pests will not return or that treatments will achieve complete eradication in all cases. Any statements about expected outcomes are estimates based on professional experience and do not constitute guarantees. We do not warrant against damage to property, personal injury, or economic loss resulting from pest presence, pest activity, or treatment application. Any limited warranties specifically set forth in a signed service agreement shall control and are exclusive of all other warranties.

User Responsibilities

You agree to cooperate fully with New Jersey Pest Control to facilitate effective service delivery. Your responsibilities include: providing accurate and complete information regarding pest problems, property conditions, prior treatments, and health concerns of occupants; ensuring safe access to all treatment areas; properly preparing premises according to our written or verbal instructions before scheduled service; removing or protecting food, dishes, pet bowls, toys, and other sensitive items as directed; keeping children, pets, and vulnerable individuals away from treated areas for the specified re-entry interval; notifying us of any pesticide sensitivity, allergies, or medical conditions of occupants; maintaining the property in a manner that does not encourage pest harborage or reinfestation; and promptly reporting any concerns or recurrence of pest activity. Failure to fulfill these responsibilities may void any limited service commitments, reduce treatment effectiveness, and result in additional charges for follow-up services. You represent that you have authority to authorize pest control services for the property in question.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEW JERSEY PEST CONTROL'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: PROPERTY DAMAGE; PERSONAL INJURY; LOSS OF PROFITS; LOSS OF USE; BUSINESS INTERRUPTION; ALLERGENIC OR CHEMICAL SENSITIVITY REACTIONS; OR DAMAGE TO PERSONAL PROPERTY, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation applies to all claims, whether based on contract, tort, strict liability, negligence, or any other legal theory, and survives termination of our services. You acknowledge that pest control involves inherent risks and that our pricing reflects this allocation of risk.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade names, photographs, videos, written materials, treatment protocols, software, and other intellectual property displayed on our website, marketing materials, or used in connection with our services are the exclusive property of New Jersey Pest Control or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You are granted no right or license to use any of our intellectual property except as necessary to receive the services for which you have contracted. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our materials without our prior written consent. Any feedback, suggestions, or ideas you provide regarding our services may be used by us without restriction or compensation.

Governing Law

These Terms of Service and any dispute arising out of or relating to our services shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these terms or our services shall be instituted exclusively in the state or federal courts located in New Jersey, and you irrevocably submit to the jurisdiction of such courts. You waive any objection to venue in such courts. These terms are further subject to all applicable federal laws and regulations, including the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and regulations of the United States Environmental Protection Agency. Nothing in these terms shall be construed to restrict your rights under consumer protection laws of New Jersey that cannot be lawfully limited by contract.

Changes to Terms

We reserve the right to modify, amend, or update these Terms of Service at any time in our sole discretion. Changes will become effective immediately upon posting to our website or other notification to you, unless otherwise stated. Your continued use of our services after any such changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically. Material changes affecting your rights or obligations will be communicated to active customers with reasonable advance notice when practicable. If you do not agree to the modified terms, you must discontinue using our services and notify us in writing. Previous versions of these terms are available upon request.
